Decision on Amending the Regulation of the People's Republic of China on the Customs Protection of Intellectual Property Rights

Decision on Amending the Regulation of the People's Republic of China on the Customs Protection of Intellectual Property Rights went into effective on April 1, 2010.


According to the decision, the revised regulation includes 33 articles in 5 chapters, which are General Provisions, Record Filing of IPRs and etc. The regulation improves the system of altering and canceling the recordation of IPRs, contains some new provisions on withdrawing of protection application. In the circumstance that the Custom shall release the detained suspected infringing goods, it add the provision that the holder of IPR would withdrawal the application before the suspected infringing goods are determined by Custom.
