The Supreme People's Court is drafting the "Opinions" manuscript on intellectual property trial work

 

The Trial Tribunal on Intellectual Property of the Supreme People's Court is working hard to draft the "Opinions Concerning the All-round Strengthening of the Intellectual Property Trial Work as a Judicial Guaranttee for the Building of an Innovation-Type of a Country" (hereinafter called the "Opinions".)

The Decision of the Party Central Committee and the State Council Concerning the Implementation of the Outline of the Science and Technology Plan on Strengthening Independent Innovation Capability" explicitly put forward the major strategic task of building an innovation-type of a country.  In order to fully put the functional role of the people's court in making trials into fully play and to provide strong judicial guarantee for the building of an innovation-type of a country, the Supreme People's Court will enhance people's courts trial work on intellectual property under the new circumstances and put forward certain opinions.  At present, the Trial Tribunal on Intellectual Property of the Supreme People's Court is working hard to draft the manuscript on the "Opinions Concerning the All-round Strengthening of the Intellectual Property Trial Work as a Judicial Guaranttee for the Building of an Innovation-type of a Country.

It was learnt that the "Opinions" manuscript is divided into 4 parts with 30 articles.  The 4 parts are respectively: Part I Fully understand the important significance of all-round strengthening to intellectual property trial work for the provision of judicial guarantee in building an innovation-type of a country; Secondly; Part II The guiding thoughts, overall requirements and fundamental principles of the intellectual property trial work of the people's court at the new stage; Part III Fully make the functional role of various trials on intellectual property protection and promote independent innovation into full play; Part IV Substantially strengthen the all-round protection for intellectual property trial work by adopting powerful measures.

Opinions have been solicited for the amendment of the "Opinions" manuscript from the related tribunals and rooms of the local people's courts throughout the country as well as from the Supreme People's Court respectively.  It is hoped that the "Opinions" manuscript will be deliberated by the representatives of intellectual property judges nationwide at the National Forum on Intellectual Property Trial Work.  Cao Jiamin, Vice-President of the Supreme People's Court attaches greatest importance to the formulation of the "Opinions" and has given instructions on the drafting work for a number of times.
