On November 13, Tian lipu, Commissoner of the Chinese State Intellectual Property Office met Mr. Jon Dudas, Under Secretary of Commerce and director of the Department of Commerce's United States Patent and Trademark Office (USPTO), and his party in Beijing. Both sides exchanged opinions on the formulation of China's state intellectual property strategy and the 3rd amendment to China's Patent Law and other issues. They also conducted friendly consultation on how to strengthen the exchange and cooperation between the two offices.
Tian said that "According to the schedule, SIPO is estimated to finalize the formulation work by the first half of 2007 and the implementation of which will be carried out in the second half of the year. And the 3rd amendment to the Patent Law will be listed in the legislation plan of the Working Office of the Bureau of Legal Affairs of the State Council and will be finalized by 2008. In this process, China welcomes the constructive opinions from the U.S. side."
China and the U.S. have maintained good cooperation relations in patent and trademark fields. Mr. Dudas highly commended the achievements China has made in intellectual property work. He said that being one of the five biggest intellectual property bureaus in the world, the rapid development of SIPO is obvious to all. He proposed that an automatization experts team be set up by both sides for the purposes of exchange and the further deepening of the cooperation in the Sino-US retrieve work. Tian said that SIPO will give an active response to this proposal.
Besides, both sides conducted extensive exchange on how to publicize the intellectual property consciousness, the training of patent examiners and other issues.
On November 13, Li Yuguang, Deputy Director of the State Intellectual Property Office met with the examiners from the USPTO. Both sides carried out in-depth exchange on the Sino-US Second Stage Joint Retrieve work as well as the retrieve strategy and instruments of the identical cases.
Li Yuguang highly commended the joint retrieve work conducted by the Chinese and American offices. He said that the Sino-US Joint Retrieve work provides a good opportunity for the both sides to exchange opinions with and to learn from each other. And it is gratifying to note that both sides are willing to continuously enhance cooperation in the aspect of joint retrieve work. The related person in charge of the Examination Business Management Department, SIPO gave a brief account on the latest situation of SIPO to the U.S. visitors and also a detailed introduction to patent application and grant of patent rights by SIPO. The examiners who are engaged in Sino-US Joint Retrieve work also conducted an in-depth exchange on how to carry out the second stage joint retrieve work.
It was learnt that as early as July 23 to 29 this year, four patent examiners from the medicine and telecommunication sectors under SIPO left for the United States and they conducted exchange with the examiners of the US. Patent and Trademark Bureau on the results of the retrieve jointly applied by the Chinese side and the U.S. side in these two sectors.
