The Customs Enforcement System for IPR Protection Set to Kick-off

 

The Enforcement System for Customs Protection of IPR will go live in 2007, which will make information sharing of IPR cases across all customs offices in China possible.

 

In recent years, Chinese port customs have been heavily engaged in the numerous investigations into IPR violations. When cases are getting more complicated and perpetuators' tricks for evading law enforcement are becoming more diversified, information sharing of related cases among all Chinese port customs will greatly improve their work efficiency by enhancing the information management and risk analysis. Based on the information released by this system, the General Administration of Customs PRC will create a black list of companies who have exported infringing goods. The checking rate of the declared goods from the companies in the black list will be raised during a certain period of time.

 

In addition to the said system, enhanced law enforcement by Chinese customs will focus on provinces of Gongdong, Zhejiang and Fujian as well as Shanghai. The increasingly pervasive Internet has given rise to on-line sales of infringing goods, which are still delivered by post or express mail service. This has made it imperative for the Customs to step up the law enforcement over these links. At the same time, the Chinese Customs will give more severe punishment to IPR infringing enterprises, strengthen international cooperation and improve training of field customs officers.
