The State Intellectual Property Office (SIPO) recently held an opinion soliciting conference on the Administrative Measures on Patent Pledge and the Administrative Measures on Filing Patent License Contracts. Legal Affair Department and Preliminary Examination and Flow Management Department of SIPO, representatives from local IP administrations and expert and scholars from China University of Political Science and Law, Bank of Communications Beijing Branch and related law firms attended the conference.

 

More than a decade have passed after the Provisional Administrative Measures Regarding Registration of Patent Pledge Contracts was issued on October 1, 1996, and some clauses cannot meet the demands of the current development. The two modified drafts for comment further clarify the rights and obligations of contract parties and embody the management function of local IP administration. In addition, the drafts heighten the requirements to related registration departments such as increasing their service efficiency. Participants full discussed the detailed clauses and related problems of the two drafts and suggested further clarifying the legal positions of the Administrative Measures on Patent Pledge and the Administrative Measures on Filing Patent License Contracts in the Patent Law and its rules of implementation.
