Six Government Departments to Jointly Supervise IPR Trading Markets

 

The National Development and Reform Commission, the Ministry of Finance, the Ministry of Science and Technology, the State Administration of Industry and Commerce, the National Copyright Administration, and the State Intellectual Property Office jointly issued The Guidance of Establishing and Completing IPR Trading Market recently, and promised to promote the establishment of IPR exchange market in China together.

 

The Guidance makes regulations in the main subject for trading, variety, trading market establishment, comprehensive arrangement, and integration of resources.

 

According to the document, the main subjects include patent rights, technological know-how, copyright as well as related rights, and other IPR, such as exclusive use of trademark, right of name and markup, and the exclusive right of layout design of integrated circuits and new variety of plants. The markets that meet the conditions can trade ownership or shares of a limited company, which are reflected by IPR. This trading activity can take different forms, such as transform, licensing and becoming shareholders.

 

The guidance states that a guiding committee, headed by the National Development and Reform Commission and consisting of the six-mentioned departments as well as China Security Regulatory Commission, the State-owned Assets Supervision and Administration Commission and IPR trading market administration offices of some provinces and municipalities will be set up to instruct and coordinate the establishment of the market. Meanwhile, a censorship system will be built up, and component authorities also will establish a special censorship mechanism to some key trades, and enforce IPR protection based on their own function and responsibility.
