For unifying law enforcement standard and enforcing experience exchange, SIPO Patent Reexamination Committee sets up a regular meeting mechanism with China Supreme Court, Beijing Superior Court and Beijing and Beijing No.1 Intermediate Court. Thus, a business symposium between the committee and IP adjudication division of the Supreme Court was held recently.

 

An examiner from Administrative Proceeding Section of the committee gave the keynote speech about duplicated patent grants and relevant applications. Participants of the symposium then made profound and comprehensive discussion on related law issues from aspects of original legislative concept, value orientation, litigants' requirement and public interests, and also amendment of the Patent Law and its Implementation Rules. For further the exchange, the reexamination committee will have two examiners to work in the Supreme Court this year.

 

Both parties highly remarked the exchange mechanism, and will create more exchange opportunities so as to promote unification of infringement judgment and administrative authorization.
