Li Yuguang: Paying Attention to IP Issues in Economic Globalization

The First Session of the 11th National Committee of the Chinese People's Political Consultative Conference (CPPCC) convened in Beijing on March 3, 2008. Li Yuguang, member of the 11th CPPCC National Committee, member of China Democratic National Construction Association (CDNCA) and also Deputy  Commissioner of SIPO, attended the discussion of the two organizations in the afternoon of March 4.

 

Mr. Li, talking about IP issues China has in its involvement of economic globalization, suggested China make Anti-monopoly Law on IP, establish and complete public IP information service and early-warning systems in international trade, give more support to innovation, and upgrade China's IPR deposit and quality.

 

IP issues, Li continued, has been part of core in China's economic development in the past years when China becomes more and more involved in globalization. Since 2005, trade barriers set with IP reasons have suffer Chinese enterprises great losses as the most serious ones, involving 100 commodities, valuing US $ 200 billion. In 2007, US even sued China to WTO about copyright problems, one about infringement and the other about restriction to American movies, music and books to Chinese market.

 

According to Mr. Li, there are three reasons leading to the IP disputes. The first is the incomplete anti-monopoly legal system in IP; the second is lacking of IP public information system and the mechanism to forecast and deal with international IP issues, and thus IP administration can not provide necessary instruction and assistance to enterprises; and the third is the weak independent innovation capacity of Chinese enterprises, and weak awareness to protect their own interests with relevant laws.
