Recently, Zhengzhou Intermediate People's Court of Henan Province publically tried a case of selling detergents and cosmetics with counterfeit trademarks at the moot court of the School of Law of Zhengzhou University, pronouncing the defendants to compensate the accuser 60,000 yuan for various losses.
In the case, the defendants, Li and his wife open a store of cosmetics in Zhonglu Detergent and Cosmetic Market in March 2004 to sell the detergents and cosmetics that counterfeit and imitate the trademarks of the accuser, Guangdong Panda Daily Chemicals Co., Ltd., such as Lafang and Raclen. In 2005 and 2006, administrative law-enforcement departments investigate and deal with Li's store three times in succession. Guangdong Panda Daily Chemicals Co., Ltd. sues Li and his wife, requiring a compensation of various losses of 350,000 yuan.
During the trial, both the defendants and the accuser have fierce discussion on the practices, measures, seriousness and scope of the right infringement. Finally, the court pronounces compensation from the defendants to the accuser of 60,000 yuan.
The trial also leaves deep impression upon the students at visitors' seats, saying that IPR infringements can be easily seen in the society, but most people do not know how to protect their legal rights and interests through legal procedures. Many students add that the school should strengthen education on IP-related laws and regulations so as to foster more professional law talents for IPR judicial protection.
