Cartier Awarded 500,000 Yuan in Trademark Dispute

Shanghai No.1 Intermediate Court entered a first-instance judgment on Cartier's allegation of Foshan Mingkun Ceramic Company, Jinsi Yuma Decoration Materials Co., Ltd and a Shanghai distributor surname Li's infringement of its Cartier and 卡地亚 recently, ordering the three defendants to cease infringement and jointly indemnify 500,000 yuan in damages to the France-based jeweler.


After discovering the three defendants used its registered trademarks Cartier and 卡地亚 on their ceramic products, the court held that though the ceramic products distributed by defendants did not share the same class with the registered trademarks in question, the mark卡地亚 was already determined as well-known mark and should be protected beyond the original class. The decision was made accordingly.
