Giorgio Armani's Switzerland branch company recently filed a court case against Trademark Review and Adjudication Board (TRAB) under the State Administration for Industry and Commerce to Beijing No.1 Intermediate People's court for approving registration of the No.1724617 trademark Arman and its figure by Xinjiang Arman Industrial Co., Ltd.
The trademark Arman in question was filed for registration by Xinjiang Arman in December 2000, and is used on decorative fabrics, bath linen except clothing and napkins of textile in class 24. Armani sought reversal of TRAB's decision.
Armani held that the trademark in question constituted similarity with their registered trademarks of GIORGIO ARMANI、EMPORIO ARMANI and Armani in Class 24. Such act constituted likehood of confusion among the public and made Armani suffer the financial loss. So Armani held that the trademark in question should not be approved for registration.
