On May 13, plaintiff Microsoft eventually settled with the defendant over civil compensation in the Tomato Garden case in Suzhou Intermediate People's Court, Jiangsu Province. Microsoft was awarded 3 million yuan.
From December 2006, the defendant Hong Lei created the Tomato Garden version of the Windows XP with Chengdu Gongruan Internet Company, which copied the programs, and embedded plug-ins of multiple internet companies.
In July 2008, Microsoft complained to the Ministry of Public Security about the piracy of Tomato Garden. On June 3, 2009, the procuratorial organs sued Chengdu Gongruan and the four defendants to Huqiu District Court in Suzhou. On August 20, 2008, the Huqiu Court made the first instance judgment. Microsoft then brought the case to Suzhou Intermediate People's Court and sought 8 million yuan in damages. Under the mediation in the Suzhou Intermediate People's Court, finally, the two sides agreed to settle over the 3 million yuan civil compensation.
