The case lodged by Korea Gingseng Corporation (Korea Gingseng) challenging Beijing Jointown Pharmaceutical Co.,Ltd (Beijing Jointown) and Guangdong Zhenghan Pharmaceutical Industry Co., Ltd (Guangdong Zhenghan) for infringement of their trademarks and unfair competition was heard by Beijing No.1 Intermediate Court recently.

Korea Gingseng discovered on July 2007, without its authorization, the ginseng they bought from Beijing Jointown which produced by Guangdong Zhenghan used trademark "正韩庄" and figure on the packages which are similar with their registered trademark of No. 3117628, No.3117450 and No.1698742. Korea Gingseng took the view that the two companies used the similar marks in ginseng which would cause confusion among consumers. The plaintiff then sought injunction and 300,000 yuan in damages for unfair competition.

As of now, the court has not yet rendered a ruling. We will follow the development of the case.
