Claiming that CUIPPC, a firm specializing in IP-related enforcement and investigation, violated trademark power of attorney contract, ABB recently brought the case to the Beijing No.2 Intermediate People's Court.
The two companies reached a trademark power of attorney in 1996. According to the contract, ABB entrusted CUIPPC to investigate all the trademark-related infringement cases in China’s mainland.
ABB claimed that they discovered CUIPPC has failed to execute the contract, but funded to establish a factory manufacturing the counterfeit goods with registered ABB trademarks. CUIPPC then charged the buyers with counterfeit goods. ABB held that the bogus investigation violated the agreement they have reached, seriously damaging their right and interests. And ABB sought 6.69 million yuan in damages.
A principal of CUIPPC told our reporter that the suit is of complete absurdity.
