Six years after its settlement over a trademark dispute with Hong Kong Crocodile, French designer Lacoste launches another offensive. The company recently brought a trademark infringement case to Beijing No.2 Intermediate People's Court, alleging infringement of Beijing Pufeng Lianhua Supermarket and Wenzhou Baoerkang Shoe Company.
In November 2008, Lacoste found Baoerkang-made leather shoes bearing label similar to its Lacoste trademark was for sale at the Supermarket. Lacoste then sought 300,000 yuan in damages from the Court.
Baoerkang contends that it uses the trademark with the authorization from Hong Kong Crocodile. The trademark is neither identical nor similar. No infringement is established. It sought rejection of the plaintiff's claim by the court.
The case is pending for further trial.
