The Ad Hoc Committee on IP Case Trial Theory of the Institute of Trial Theory under China Law Society was established on the afternoon of November 29 in Chongqing.

According to Xi Xiaoming, Vice President of the Supreme People's Court and Deputy Director of the Institute of Trial Theory under China Law Society, the establishment of the Committee is of great significance in terms of pooling the research strength of IP case trial, integrating research resources, encouraging and transforming the research achievements, strengthening theoretical improvement, and training and applying talents of law research.

With the progress of science and technology and the development of economic, social and cultural causes, people's demand in IPR judicial protection is increasing and the scope of IPR judicial protection is expanding with new types of cases and difficulties emerging constantly.

The category IP cases accepted by the people's courts has been expanded from traditional fields such as copyright, patent and trademark to new areas such as internet copyright, new plant variety, integrated circuit layout design, folk literature and art, internet domain, anti-monopoly, chartered operation and judicial affirmation of renowned brands.

"Facing these new cases and difficulties, only through strengthening theory researches of trying IP cases and earnestly studying the relations between new types of cases and difficulties and the legal development, scientific and technological progress and social development can we constantly improve our levels of hearing IP cases," says Xi.

Xi points out that the research on the theory of IP case trial should take China's scientific and technological development and industrial IP policies into consideration. For the systems and regulations of IP case trial in foreign countries, "we should not accept all of them blindly or reject them without discrimination."

Members of the Ad Hoc Committee on IP Case Trial Theory include judges with abundant experience, experts and scholars who are active in the frontline research of IP theory and officials from related administrations.

On the morning that day, the first IP tribunal of "three-in-one" trial mode in China's west region is inaugurated in Yuzhong District People's Court in Chongqing. The tribunal can break the borders of various tribunals and mobilize judges of criminal and administrative trials.
