The Shenyang Intermediate People's Court entered the first-instance judgement, holding that New Apple Concept Digital Technology Co Ltd used logo similar to Apple's registered trademark and ordering the Shenzhen-based company to pay the US electronics giant 400,000 yuan in damages.

The Shenzhen company, established in October 2005, used the pattern similar to the above registered marks on its products, wrappings, promotional materials and website.  In addition, it used a logo similar to Apple's another registered mark iPod on its products and wrapping in a highly visible manner. 

The U.S. company brought case to the Shenyang court last March.  The court held the defendant's trademark infringement is constituted and is also liable for the unfair competition.
