No Complaint Related to Beijing Olympic IPR Protection During the Olympic Games

According to the Summing-up and Commendation Meeting of the Beijing commerce and industry administration setups held on September 7, Beijing makes great achievement in Olympic IPR protection during the Olympic Games with no complaint emerging in three aspect: no complaint from right holders of international renowned brands in key regions and key markets, no complaint from the Olympic international partners, suppliers and sponsors in IPR protection and no complaint from the vast consumers at home and abroad related to IPR.

According to Zhang Zhikuan, Director of Beijing Administration for Industry and Commerce, departments of Beijing industry and commerce administration has established the emergency respond system to conduct risk analysis in every link and aspect that might lead to Olympic IPR infringement and check the system through all-round real practices, further improving the capacity of rapidly responding to IPR-related emergencies.

In order to protect Olympic IPRs, Beijing Administration for Industry and Commerce prints and issues the Working Plan of Olympic IPR Protection and the Action Plan of Protecting the Exclusive Rights of Olympic Symbols, and fully implements the systems of trademark authorized operation and demonstration shopping malls with no trademark imitation. Meanwhile, for some new problems emerges during the process of Olympic IPR protection, Beijing Administration for Industry and Commerce timely communicates with Beijing Organizing Committee of Olympic Games so as to properly deal with the problems such as the utilization of Olympic symbols and defining the practice of ambush marketing.

Starting 2006, departments for industry and commerce in Beijing brings the appointed manufacturers and franchise of Olympic products into the grid management system, requiring grid responsibility bearers to conduct real-time supervision upon them so as to establish the law-enforcement network system of Olympic symbol touring inspection.

Mr. Zhang says that departments for industry and commerce in Beijing strengthens the routine inspection in various business links of products with Olympic symbols and international renowned brands such as commodity distribution centers and retail centers, conducts one-to-one rectification to the practices of selling IPR infringed commodities, illegally printing Olympic symbols and various advertisements that infringe Olympic symbols in a centralized manner, and launches regional positioning and registration management. By September 16, a total of 1,262 cases of trademark counterfeits and imitations have been concluded with a fine of 14.72 million yuan and 378 Olympic symbol-related cases with a fine of 4.81 million yuan.

Focusing on protecting Olympic IPRs, departments for industry and commerce in Beijing strengthen their supervision on Olympic-related advertisements, effectively controlling Olympic IPR infringing advertisements. During the Olympic Games, they totally supervise 142,576 advertisements with no Olympic IPR infringing advertisements discovered.

The progress in Olympic IPR protection is highly appraised by the international community. IOC Director of Legal Affairs, Mr. Howard Stupp visits Beijing Administration for Industry and Commerce twice before and after the Olympic Games, highly appraising Beijing's efforts in protecting Olympic IPRs. According to a report of Reuters on August 19, visitors can rarely find IPR infringing Olympic commodities in Beijing during the Olympic Games.
