CISCO Trademark Dispute Settled

CISCO settled a trademark dispute with an alleged infringer from Shenzhen.  With court intervention, the defendant agreed to make a public apology and indemnify 200,000 yuan in damages.

CISCO sued the Shenzhen company and Wang, its representative of the legal person for infringing its trademarks CISCO SYSTEMS and the figure at Futian District People's Court.  CISCO claimed it owns trademarks, CISCO, CISCO SYSTEMS and the figure, all registered at the Trademark Office of the State Administration for Industry and Commerce.  The Shenzhen company has been selling counterfeit routers and switches affixed with the above trademarks since July 2006.  The act has misled the public and caused great damages to CISCO.  It sought injunction, 500,000 yuan in damages, public apology.

The two defendants contended they never committed infringement of the CISCO trademarks and sought rejection of CISCO's claims on the ground of insufficient evidence supporting the damage calculation.
