On May 28, Xu Rongkai, Member of the Standing Committee of the National People’s Congress (NPC) and Deputy Director of NPC’s Education, Science, Culture and Health Committee leads a research group of legislation of the Patent Law (revised) of NPC’s Education, Science, Culture and Health Committee to Shanghai for a two-and-a-half-day discussion and inspection. SIPO Deputy Commissioner He Hua accompanies the group in Shanghai.

During the inspection, the research group holds a symposium with participants from Shanghai People’s Congress, courts, related governmental departments, colleges and universities and scientific research institutes. The participants discuss freely on issues such as promotion of independent innovation through patent systems, improvement of service invention system, patent administrative law enforcement, administration of patent rights, reasonable standardization of patent right exercise, prevention of patent right abuse, improvement of legal proceeding of patent infringement and the simplification and improvement of the litigation procedures of patent invalidation on the basis of modification draft for opinion soliciting published by the Legislative Affairs Office of the State Council on February 28, 2008. Their suggestions include not only modifications to some specific clauses in the draft, but also many constructive complete plans, providing sound references for the smooth modification work of the Patent Law.

While in Shanghai, the research group also inspects the Research and Development Department of the demonstration enterprise of IP work, Shanghai Highly (Group) Co., Ltd. and talks with representatives of some enterprises to know more about their opinions on the modification of the Patent Law. After that, the group will specially listen to the opinions from patent agencies and visit Shanghai Institute of Micro-system and Information Technology of Chinese Academy of Sciences and Shanghai Multimedia Park.
