Montagut Nails down First Instance in Shanghai

In its ruling over the trademark infringement and unfair competition case of Montagut, Shanghai No.2 Intermediate People's Court grants injunctive relief and monetary relief of 500,000 yuan to the French fashion maker. The court also finds 梦特娇 (trademark in Chinese), Montagut plus floral pattern and the floral pattern alone are well-known marks.

In 2005, Bonneterie Cevenole S.A.R.L, right holder of Montagut, claimed the defendant Shanghai Mengtejiao Investment Management Company uses Mengtejiao (note: identical with the above Chinese trademark), Montagut plus the floral pattern and France Mengtejiao Laundry in its web site www.mtg1890.com, promotional materials and plaques of its laundry outlets. The French company then filed suit to the court on the ground of trademark infringement and unfair competition.

Attorney for the plaintiff said, his client registered the aforementioned trademarks and has been using and promoting them for an extended period of time which has made them profoundly known among the relevant Chinese public.
