The supreme People’s Court: China Is Innovating in Its IP System in All-Round Way

(Xinhua News Agency) Vice president of Supreme People's Court Xiong Xuanguo, who is also a chief justice, indicates on April 15 in Beijing that with the implementation of a series of measures, China’s IP system is experiencing all-round innovation.

Speaking at the International High-Level Symposium of IP Judicial Protection, Mr. Xiong notes that China’s national IP strategy is recently discussed and adopted in principle by the State Council, which focuses on many important areas such as optimizing IP system, promoting IP creation and utilization, strengthening IPR protection, preventing IPR abuse and cultivating IP culture. Strengthening the IP justice system construction and bringing the mainstream roles of IP judicial protection into full play will be the important content of the national IP strategy.

Mr. Xiong says that on the basis of widely soliciting opinions from various local courts, enterprises and lawyers, the Supreme People’s Court has started to formulate judicial interpretations on judicial confirmation of well-known trademarks. The Judicial Interpretations on the Applicable Laws in Trying the Criminal Cases of Business Secret Infringement is also listed in schedule. The Judicial Interpretations will further clarify the conviction standard of the crime of infringing business secrets to ensure the security of business information and a fair environment for commercial competition.

Meanwhile, the Patent Law, Trademark Law and other basic IP laws are being considered to be revised again; the formulation work of IP-related laws and regulations such as Law of Business Secret Protection and Regulations on Protecting Folklores are listed on the working schedules.

“All these indicate that China is innovating in its IP system in all-round way,” said Mr. Xiong.
