Administration Measures of State-Owned Copyright Asking for Comments

Hosted by the National Copyright Administration (NCA), a special meeting for commenting on the draft of Administration Measures of State-Owned Copyright was held on February 15 in Beijing. More than 20 specialists attended the meeting, and gave their ideas to the document.

Main topic of the meeting was on the possibility for the State to own copyright. An official from NCA said the issues about the coverage of State-Owned copyright, the proper date for the State to obtain the right, and how to regulate registration and declaration of State-owned copyrights were the NCA's interests in the meeting.

Mr. Ma Yinan, a professor from Peking University, said that the State-owned copyright should obtain by the procedure regulated by the Civil Procedure Law, and the date obtaining the copyright should the day the Court concludes instead of the day of the citizen died.

When talking about the management to the copyright or relevant benefits by the institution designated NCA, how to cover the expenses during the management and whether the management is profitable, Mr. Pan Jianfeng, a professor also from Peking University, believed that as a part of State asset, the institution can enjoy profit from the management, but income should completely handle to the State, while the expenses should be covered by State either.

Professor Xiao Jianguo from China People's University, suggested that unauthorized use of the copyright, even when the copyright holder do not exist any more, or change its name, all constitute infringement, and relevant department also have the right to investigate.
