Foxconn's allegation of BYD's misappropriation of its trade secret, proclaimed the No.1 IPR dispute in high-tech area in China, has seen some breakthrough development. Beijing Jiuzhoushichu IPR Appraisal Center has completed its appraisal report of relevant evidence. The report concludes a large portion of documents brought by former Foxconn executives to BYD contain proprietary information which could bring economic value to companies in the industry.
The trade secret dispute between Foxconn's two subsidiaries, Shenzhen Futaihong Precision Industry and Hong Fu Jin Precision Industry and BYD at Shenzhen Intermediate People's Court came to this evidence appraisal earlier November, when a party challenges some technical issue. The Shenzhen court then forwarded the request to the Supreme People's Court as required by the law. The Supreme Court then assigned the appraisal task to Jiuzhoushichu.
The result of the appraisal is viewed as a major breakthrough and tangible development. Observers in the industry predict Foxconn may has a better chance now.
