More Complaints for IPR Infringement in the 1st Phase of the 102nd China (Canton) Import and Export Fair

According to the statistics offered by the Fair office, as compared with the same period of the spring Fair of this year and the autumn Fair of the last year, the turnover of the 1st phase of the 102nd China Import and Export Fair, concluded on the 20th of Oct.2007, reached $24.97 billion and increased 4.1% and 12.5% respectively; the number of buyers, totaling 123,118 this time, decreased 9.5% as against with the number of the spring fair this year, while raised by 1.3% against with that of the last autumn fair.

It is noticeable that the complaints of the intellectual property rights (IPR) infringement accepted by the Fair office were increased this time due to the enterprises' enforced sense of IPR protection. Based on the introduction given by Xubing, the spokesman of the Fair, 261 cases concerning the IPR infringement have been received, and 391 enterprises were reported as respondent from this Fair. Among which, the number of complaints, the respondent companies and the suspected firms in the export section have been raised by 31%, 25% and 35% respectively comparing with the numbers at the same period of the previous fair. The complaints from the import section, however, have been reduced.

Five Enterprises are Disqualified From the Six Following Exhibitions

There have been five exhibitors sent off for infringing the IPRs and for selling (buying in) booths underground, and three were publicly warned.

In accordance with the report, Hangzhou Xiaoran Import & Export Co.,Ltd and Shengzhen Yiyatong Supply Chain Co.,Ltd., were disqualified in the future six exhibitions for their IPR infringement behaviors. In addition, Wenzhou Electric Manufacture Co.,Ltd., Chaozhou Pengjia Ceramics Industry Co.,Ltd. and Jinhuarunhua Foreign Trade Corp. were warned for infringing three or more than three IPR serial numbers.

Moreover, Henan Kaida Trading Co., Ltd, Beijing Wasson An-Ze Bio-Tech.Co.,Ltd and Shandong Dongyue Science & Technology Development Co.,Ltd. were also not qualified the six following Exhibitions from this time for exhibition violation.

The Catalogue of the serious IPR Infringements is Publicized

According to the Intellectual Property Administration of Guangzhou Municipality that the IPRs protection work for this Fair has been further intensified. It not only encouraged all trading delegations and chambers of commerce to promote the self-investigations and adjustments of the exhibitors, but also accumulated penalties by amending the Approaches for the Complaints of IPR Infringement.

Basing on the prescription, warning letters will be sent to enterprises which infringe the IPRs for the first time. Enterprises which violate the patent rights and copyrights on consecutive for two or three times in total, and infringe trademarks and counterfeit others' patents and trademarks on purpose will be announced and disqualified from the following six fairs.

What's more, enterprises who display the exhibits that have been declared as IPRs violation already or who disqualified for several fairs and violate IPRs again after the penalty will never be qualified to the Fair.

In a addition, during the Fair, if one IPR serial number is infringed by over 10 enterprises at the same time (ie. extensive IPR infringement),or one enterprise violates above three IPR serial numbers, all these enterprises will be disqualified from the next Fair.

The Turnover of Guangdong Trading Delegation Ranked the Top

With its $6.52 billion turnover, the Guangdong trading delegation ranked the top of the all Chinese delegations from various provinces, regions and municipalities, wile Zhejiang and Jiansu trading delegations were the second and third respectively.

Xubing noted that although the number of the buyers were a little bit fewer this time, we still attracted 25,630 purchasers from EU, increasing 9%   as compared with that of the last Fair.

The 2nd phase of the Fair will be hold at Liuhu Complex and Pazhou Complex at the same time on between the 25th  and 30th of Oct. The former is for gifts while the later, for consumer goods.
