Nothing Beats a Bud, Budweiser Prevails in Trademark Dispute

On August 21, the Shanghai No.1 Intermediate People's Court made the first instance judgment on the case in which American Anheuser·Busch Inc. sued Putian Jinshi Beer Co. Ltd. for trademark infringement. The court ruled that the New Generation beer manufactured by Jinshi infringed the trademark of Budweiser.  Jinshi and its four distributors shall cease the infringement and Jinshi indemnify 500,000 yuan in damages to the plaintiff.

Anheuser·Busch Inc. registered the word mark "百威" (Budweiser).  In April 2006, Anheuser·Busch Inc. found the infringing beer manufactured by Jinshi Beer in Shanghai, Jiangsu and several other locations.  Jinshi Beer used mark which was similar to those of Budweiser’s figurative mark of ribbon and wheat ear, and also emphasized the words Budweiser Beer International Group Co. Ltd. on the packages.  Shanghai court  made the above judgment after hearing.
