Recently, the "Guiding Opinions for the Banks to Develop Small Enterprise Credit Work" (hereinafter referred to as the "Guiding Opinions") was released by the China Banking Regulatory Commission (CBRC). The "Guiding Opinions" confirmed the demarcation standard for credit of the small enterprises for the first time, resolved the regret of China's financial system for lack of a demarcation standard and concurrently the conditions for the small enterprises to obtain loans are relaxed for the first time. Henceforth, the small enterprises may obtain loans from the Chinese commercial banks on the strength of the pledged property in trademark exclusive right, patent, copyright and other intellectual properties.
There are 31 articles in the "Guiding Opinions", in which, guiding opinions are offered to the banks in terms of demarcation standard for credit of the small enterprises, overall requirements, organizational structure, business procedure, risk prevention and encouragement and restraint mechanisms. The "Guiding Opinions" has expanded the credit business of the small enterprises, the objects for credit and the subject scope of credit, relaxed the quality verification requirements of the small enterprises for credit assets, the conditions for credit examination and verification, the category of loans, the scope of the pledged articles, the guaranty conditions and the standard for credit evaluation.
The relevant person-in-charge of the CBRC stated that the newly issued "Guiding Opinions" has expanded the scope of the credit banks, including all the commercial banks and the policy banks.
