China's Software Copyright Registration Exceeds 10,000 Pieces in the First-half of 2007

"The Statistic Report on China's Computer Software Registration in the First-half of 2007 " was published by the Copyright Protection Center of China (CPCC) on July 11, 2007. Statistic data indicate that the number of computer software registration in the first-half of 2007 reached 11,400 pieces, a year-on-year growth of 8.21 percent, the greatest ever in terms of the number for registration over the years, of which, the number of computer software copyright registration handled by the Copyright Protection Center of China were 10,800 pieces, accounting for 94.99 percent of the total number of registration. The Statistic Report also made comparisons on the registration situation of various places, for the first time, in the form of a rank list.

As introduced by Duan Guijian, Director of the CPCC, according to the statistic on the situation of the locality of the registrant, the first ten provinces, autonomous regions and municipalities under the Central Government in terms of the number of software copyright registration in China are as follows: Beijing, Guangdong, Shanghai, Zhejiang, Jiangsu, Fujian, Shandong, Hubei, Sichuan and Tianjin, of which, Beijing Municipality is in the first place, with the number of software registration of 3962 pieces in the first-half of the year, a year-on-year growth of 7.28 percent, accounting for 34.71 percent of the total number of registration, Guangdong Province is in the second place, with the number of registration of 1365 pieces, a year-on-year growth of 9.73 percent, accounting for 11.96 percent of the total number of registration; Shanghai Municipality is in the third place, with the number of registration of 1261 pieces, a year-on-year growth of 13.30 percent, accounting for 11.92 percent of the total number of registration; Zhejiang Province is in the fourth place, with the number of registration of 858 pieces, a year-on-year growth of 5.15 percent, accounting for 7.52 percent of the total number of registration; Jiangsu Province is in the fifth place, with the number of registration of 750 pieces, a year-on-year growth of 32.51 percent, accounting for 6.57 percent of the total number of registration. It could be seen from the rank list that the first five places are all coastal economic development regions. The number of registration for software copyright in these five regions account for 72.68 percent of the total number of registration. Whereas the above-mentioned rank order is basically identical to the status occupied by the software development scale and level of the various places in China.

Regarding the reason for the sustained increase of the number of software registration, Duan made some analysis in his reply to the questions raised by the correspondents.  He said that in recent years the number of software registration in China increased by 5000 pieces annually on an average and the number of registration for software copyright is also in sustained high-speed growth. This shows the implementation of "Certain Policies on Encouraging the Development of the Software Industry and the  Integrated Circuit Industry" has achieved obvious results and China's software and information service industry has maintained good momentum for development. The constant increase of the number of registration for software copyright also reflects the rapid upgrading of the capabilities for original innovation, integrated innovation, induction, digestion and re-innovation and displays the achievements of the software industry in upgrading the independent innovation capability, enhancing the core competitive edges of the enterprises and constantly researching and developing the technology having independent intellectual property right.

He also stated that through the large numbers of software copyright registration by the software industry, the adaptability for the implementation of protection for the copyright and the effective protection of the software copyright registration system over the software industry can also be reflected.  As the object under the protection of the Copyright Law, software works are having the salient features of non-ocular, non-discernible and easiest for amending and reproduction. Therefore, the software copyright registration system is stipulated in the "Regulations for the Protection of Computer Software" promulgated by the State Council. Many years of practice have   proved that in terms of the other literature and art works relatively, software copyright registration has more realistic significance for the software copyright owner in its exercise and safeguarding of the legitimate rights. The items in the software registration as initial proof is playing an important role in evidencing the right of attribution and providing assistance in enjoying the preferential policies of the state.  The software copyright registration has become an important content of software industry for the implementation of the intellectual property strategy. The software copyright registration work has also been included in the national policy and outline for the encouragement and development of the software industry.

Besides, as introduced by Duan, the spokesman of the center, according to the research and development law of "slack in the first-half of the year and brisk in the second-half of the year" of China's software industry, it is estimated that the number of registration for the second-half will increase by large margin.
