Suzuki Elevator Fined RMB 2.75M for Trademark Infringement

After five months' investigation, the Administration for Industry of Commerce (AIC) of Xiamen found Suzuki Elevator (Shenzhen)'s infringement of SEC Elevator's trademark and imposed 2.75 million yuan in administrative fines.

Earlier this year, a Xiamen-based IPR firm in representing SEC lodged a complaint to the Fair Trade Division of the AIC after learning Suzuki's sale of three elevators with SEC logos to a Xiamen real estate developer.  The AIC investigators then discovered SEC is a registered Chinese trademark under the name of SEC Elevator with its life span running from September 7, 2000 to September 6,2010.  SEC labels were affixed on the fire emergency buttons, control cabinets, towing machine and car operator of the three elevators in question.

The AIC entered the conclusion that the acts of Suzuki had constituted the trademark infringement under the Chinese Trademark Law for using an identical registered trademark on the same product without the authorization of the owner.
