Six US Filmmakers Prevails in Copyright Dispute at First Instance

The Beijing First Intermediate People's Court made a first instance decision on April 24, finding Beijing Ying Hua Zhi Xing Cultural Exchange Center and its affiliated Li Hua Zhi Sheng AV Shop having infringed the copyright of six US filmmakers including Warner Bros, and ordering the defendants to pay  damages in sum of 195,000 RMB. 

The plaintiffs claimed their copyrighted works, Before Sunset, the Hitchhiker's Guide to the Galaxy, Robots and several other film titles were sold at the defendant's premise and petitioned the court to order the two defendants to cease sale of infringing works instantly, make an apology in a public context, undo the harm, remedy damages to the plaintiffs' and afford costs for the legal action.

The court eventually ordered the AV shop to cease sale of the infringing film DVDs, remunerate damages and reasonable litigation costs ranging from 15,000 RMB to 90,000 RMB to  the respective six US companies including Warner Bros.  Ying Hua Zhi Xing was ordered to compensate if its AV shop defaulted on the payment of damages.
