Litigation Fee of Patent and Trademark Lawsuits Against Government Lowered to a Hundred Yuan

April 2 was the first working day for the court after The Measures on Litigation Fee took effect. Under these Measures, any patent or trademark complaints lodged by common people against the government shall only be charged an acceptance fee of RMB100 each, a decease of 90 percent from the original fee of RMB1000.

According to the case-filing departments of the Beijing No. 1 Intermediate People's Court, Haidian, Xicheng, Xuanwu District Courts, on the first day after the fee adjustment, the number of filings experienced a small increase at the Beijing No.1 Intermediate People's Court and Xicheng District Court and remained stable at other courts. Judge WANG He from the No.1 Intermediate People's Court said since no new detailed rules of litigation fees had been promulgated, the litigation fee of patent or trademark lawsuits would follow the lower of the range set forth in the new Measures.

The Measures on Litigation Fee was passed by the State Council at its No. 159 Executive Meeting on December 8, 2006 and promulgated by the State Council in its No. 481 order. These Measures also set forth fee standards for litigation fees of civil cases concerning Intellectual Property. According to these Measures, for claims with no value in dispute, the litigation fee will range from RMB500 to RMB1000, whereas for claims with value in dispute, the litigation fee schedule will follow that for Property cases. These Measures came into force as from April 1, 2007.
