On February 8 the Supreme People's Court released via www.chinacourt.org its major study subjects in 2007, openly inviting tenders among people's courts at various levels, scientific research units and schools of higher learning. Investigation and research on the determination of well-known trademarks is listed as one of the 10 major subjects.
The major study subjects of the Supreme People's Court include: implementation of lenient and stringent policies on criminal trial and the system of criminal action with additional civil proceedings, establishment of a judicial remedy system for victims in criminal cases, the issue of applying laws to cases of drugs, setup of a sound pluralistic mechanism of solving legal disputes, the adoption of folkways in the court judgment, improvement of the investigation system of denying one's legal status, determining well-known trademarks, and investigation regarding cross administrative and civil cases as well as application of laws to cases of dispute between hospital and its patients.
The subjects decided this year by the Supreme People's Court are in light of the current actual situation that the Central Party Committee raised the requirement to build up a harmonious socialist society and of the spirit of the conference of presidents of high people's courts in the country, and on the basis of careful study, extensive collection of comments and full demonstration. These subjects mainly focus on five aspects: first, pay attention to the overall importance of them, starting from the general situation of the work of the Party and the State, try to grasp their political orientation so as to make them closely in line with the requirement for building up a harmonious society and the specific work of court; second, pay attention to the forward looking of subjects; third, pay attention to the priority of subjects, mainly focusing on investigation of court work priorities, taking 10 major and hot issues as key subjects; fourth, pay attention to the transferability of research results of subjects, closely integrate the actual work of court without any subject that is too theoretical and of too much macro-sense; fifth, pay attention to the balance of subjects with as much as possible consideration to different areas of court work.
The Supreme People's openly announced and invited tenders from the public in respect of 10 major study subjects, with the aim to increase the transparency of court work, open up broad ways for democratic policy-decision on judicial work and fully accept social forces to counsel on the court work so that a strong, effective judicial guarantee can be provided for the construction of a harmonious society.
